Residential Tenancies Act – Changes 2021
New rental laws came into effect on 29th March 2021 in Victoria. The law changes expand the rights and responsibilities of renters and rental providers and will make renting in Victoria fairer and safer. Under the changes, the new rental laws refer to landlords as rental providers, tenants as renters, and tenancy agreements as rental agreements. Tenant Selection

Selecting the right tenant for your property is as important to us as it is to you. We guard our hard- earned reputation for providing our clients with the most suitable applications to lease their investment properties. Our Tenancy Application Form enables us to establish current and previous tenancy and employment history; as well as providing several business references. Through our strict screening process (100 Point ID check) of contacting previous landlords/agents, current and prior employers, credit reference checks, rental history, we establish a sound knowledge of the applicant’s character and reliability. Before we can give you our recommendation, we ensure we have established an overall picture of suitability, and the final choice of a tenant is yours.

Ingoing Report

Before the commencement of the tenancy, we complete a carefully detailed condition report of your property. We will also take internal photographs, where necessary or on request, prior to the first agreement. Both the condition report and photos are referred to at the end of the tenancy.

Lease Agreement

We compile all documentation about your leases and other legal tenancy provisions. It is our responsibility to ensure that legal requirements relating to the lease agreement are explained clearly to tenants and tenancy conditions are fulfilled.

An REIV (Real Estate Institute of Victoria) Lease agreement is drawn up with any agreed special conditions (that fall within the guidelines of The Residential Tenancies Act 1997).

Rental Payments

We ensure you receive your rental payments via electronic transfer into your nominated account. This usually occurs within two/three business days of receipt. A statement is forwarded to you via email following each rental payment. At the close of each financial year, an income and expenditure report is also emailed out.

Rental Backlog

We take particular care and considerable time in our tenant selection process. By adhering to our firm policy of not accepting a tenant who does not meet our stringent suitability criteria, we minimize our rental arrears. Despite our utmost care being taken, occasionally a tenant may fall into arrears. Arrears are monitored closely and daily so that tenants who fail to pay their rent for whatever reason are contacted immediately. If a tenant does not respond to our request, our established procedure is instigated.

Lease Renewals

Rents are reviewed annually, and we like to ensure that you receive full market rent for your property. We take into account such factors as current market rentals, vacancy, the general condition of the property and quality of the tenant and length of their tenancy. All increases are discussed with you for final approval.

Under the Residential Tenancies Act 1997, we must give a tenant 60 days’ notice of an increase in rental; this, of course, must come into effect after the expiration of the lease.

Repairs and Maintenance

Before tenant occupancy or within the duration of the lease, certain maintenance may be required. Maintenance is a high priority because of the cost and needs to protect your major asset. It is our strict policy that owners are contacted, and authorization is obtained before work can be carried out (except for emergency repairs after hours). We have developed a base of qualified tradespeople to cover the requirements of owners who instruct us to attend to matters on their behalf. However, upon your instruction, we can engage qualified tradespeople of your choice. Repairs carried out on your behalf are paid for from your rental funds held in trust. Full details of the repairs are printed on your monthly statement with a copy of relevant invoices attached for your tax records.

Routine Inspections

We believe in the health check of your property at regular intervals. Routine inspections are an essential part of our property management process, ensuring the well-being of both the rental property and the renters. This report summarizes the findings of the recent routine inspection conducted at the rental property. It aims to provide an overview of the property’s condition and identify any maintenance or compliance issues that require attention. We conduct the first inspection at 3 months followed every 6 months.

Exit Report

We conduct an exit Condition report with 10 days at the end of the agreement. If there is any damage to the property, then we seek compensation through BOND for the rental provider or if required approach VCAT.
